Terms of Service

1. Acceptance of Terms

KinLife ("the Service") is operated by KINTUTOR PTY LTD (ABN 83 693 239 977), trading as KINLIFEAI, a company registered in Australia ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users of the Service.

2. Description of Service

KinLife is an AI-powered family planner. You add things to it (messages, documents, photos, links, notes) and an AI assistant turns them into your shared calendar, lists, reminders, and answers. The Service includes a shared family calendar with optional Google Calendar and Apple Calendar sync, notes and lists, reminders and scheduled tasks, meal and grocery planning, budgeting, health records, a social journal, and an assistant you can reach on the web, WhatsApp, email, and Telegram. Features vary by plan. We may modify, suspend, or discontinue the Service or any feature at any time, and we will give you reasonable notice where a change materially reduces what you have paid for.

3. Eligibility

You must be at least 13 years old to create a KinLife account for yourself. By creating an account you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.

Children under 13.A parent or guardian can add a child under 13 to their family. A child under 13 may use the Service only with the consent and supervision of their parent or guardian, and a parent or guardian must be present to complete the child's account setup. The parent or guardian is responsible for that child's use of the Service, decides what information is recorded about them, and can change, restrict, or delete the child's profile and access at any time.

A parent or guardian can also add a younger child as a profile with no login at all, so the child never accesses the Service directly.

4. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Plans, Payment, and Cancellation

KinLife offers a free plan and paid subscription plans. The plans available and their prices are shown on our pricing page. All prices are in Australian dollars and include GST. The price shown is the total amount you pay: we do not add tax or any other charge at checkout.

  • Billing. Paid plans are billed in advance for each billing period, monthly or annually depending on the plan you choose. Payments are processed by our payment provider; we do not store your full card details.
  • Automatic renewal. Paid plans renew automatically at the end of each billing period at the then-current price, until you cancel.
  • Cancelling. You can cancel at any time from your account settings. Cancellation takes effect at the end of the billing period you have already paid for. You keep access to paid features until then and you will not be charged again.
  • Refunds. Except where the Australian Consumer Law requires otherwise, we do not provide refunds for the unused part of a billing period you have already paid for. Your rights under the Australian Consumer Law, including a refund where there is a major failure with the service, are set out in the Disclaimer of Warranties clause below and are not affected by this paragraph.
  • Price changes. We may change our prices. We will give you reasonable notice before a change applies to your subscription, and you can cancel before it takes effect if you do not accept the new price.
  • Failed payments. If a payment fails, we may suspend access to paid features until payment is successfully processed.

6. User Content

You retain ownership of any content you upload or create through the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process and use that content solely to provide the Service to you. You represent and warrant that you have all necessary rights to submit the User Content and that it does not violate any third-party rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Upload content that is harmful, fraudulent, or infringes on third-party rights.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated means (bots, scrapers) to access the Service without our permission.

8. Third-Party Services

The Service integrates with third-party services such as Google Calendar. Your use of those integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the conduct or content of third-party services.

9. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property ofKINTUTOR PTY LTD and its licensors. Our trademarks, logos, and service marks may not be used without our prior written consent.

10. Disclaimer of Warranties

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time, and if this is not done, to cancel the contract and obtain a refund of any unused portion.

Nothing in these Terms excludes, restricts, or modifies those guarantees or any other right or remedy you have that cannot lawfully be excluded.

Subject to the paragraph above, and to the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

Nothing in this clause limits our liability under the Australian Consumer Law or any other liability that cannot lawfully be limited.

Subject to the paragraph above, and to the maximum extent permitted by law, KINTUTOR PTY LTD and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service will not exceed the greater of AUD $100 or the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless KINTUTOR PTY LTD and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them. Nothing in this clause limits any right you have to bring proceedings in another jurisdiction where the law does not allow that right to be excluded.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
